The White Collar Crime Centre - Opening Up Civil Recovery to Individuals?

Today The White Collar Crime Centre has published a discussion paper which explores extending the civil recovery regime in the Proceeds of Crime Act 2002 to individuals. Chapter 2, Part 5 of POCA enables enforcement authorities to pursue the civil recovery of ill-gotten property in the High Court. What if the regime was available to individuals so that whistle-blowers could pursue civil recovery proceedings? The discussion paper raises the proposal for consideration, exploring the potential incentivisation of whistle-blowers, its consistency with other aspects of the UK’s legal system and need for procedural safeguards.
