The New Corporate Offence & Associated Persons

The passage of the Criminal Finances Bill 2016 will see the introduction of a new corporate offence of failure to prevent the facilitation of tax evasion. Similar to the corporate offence model in the Bribery Act 2010, a company could commit an offence if an “associated person” commits a particular wrong – namely, an offence connected to the facilitation of tax evasion.
