This case concerned the application of the National Crime Agency (“NCA”) which had received a letter of request from the United States Department of Justice (“DOJ”) asking for a prohibition order to me made under Part 4A of the Proceeds of Crime Act 2002 (External Requests and Orders) Order 2005 (SI 2005 No 3181) (the “2005 Order”). The question arose as to whether the letter of request should be disclosed.
